A family walk near Tamarack Beach ended in tragedy Tuesday night, and the driver accused of causing it is now facing some of the most serious charges California law allows in a DUI case.
What Happened Near Tamarack Beach
Vanessa Wheyland was walking near Redwood Avenue and Carlsbad Boulevard, close to Tamarack Beach, shortly before 8 p.m. Tuesday when she was struck by a vehicle. Friends said she had been out for a family walk at the time. She suffered critical injuries and was taken to a local hospital, where she was later pronounced dead.
Police identified the suspected driver as 26-year-old Fernando Saldana of Escondido, and say he fled the scene following the collision. Investigators located him roughly a mile from where Wheyland was struck, relying on evidence recovered at the crash scene, tips from community members, and automated license plate reader technology.
Why Saldana Faces a Murder Charge
Saldana’s arrest carries unusual weight because of his criminal history. Under California law, prosecutors can pursue a second-degree murder charge in certain fatal DUI cases when the driver had a prior DUI conviction and had previously been formally warned about the potentially deadly consequences of driving under the influence — a legal doctrine commonly known as a “Watson murder.”
In addition to the murder charge, Saldana was arrested on allegations of leaving the scene of a collision resulting in injury or death, DUI causing injury or death, and gross vehicular manslaughter. As with any criminal charge, these remain allegations, and Saldana is presumed innocent unless and until proven guilty in a court of law.
Saldana was booked into the Vista Detention Facility and is scheduled to appear before a judge Friday. The Carlsbad Police Department has not released information regarding his citizenship status.

Wheyland was a graduate of San Diego State University and served as CEO of Wheyland Electric, an electrical contracting company serving Carlsbad and the greater San Diego area. She’s survived by her husband and three children.
Nicole Check, who organized a GoFundMe for Wheyland’s family, described the depth of the loss in an emotional post.
“Last night, Vanessa was tragically struck and killed by a driver, leaving behind her loving husband and three children,” Check wrote. “Vanessa was a devoted wife, an incredible mother, and a cherished friend whose love and presence touched so many people. Her family was her entire world, and this devastating loss has left everyone who loved her heartbroken.”
A Community Grieving — and Frustrated
A memorial has been set up for Wheyland at Tamarack Beach, where loved ones plan to hold a vigil Thursday night.
The tragedy has also reignited frustration among neighbors about the safety of the roadway itself. Community members told NBC 7 they’ve witnessed multiple crashes in the area over the years, including previous fatal collisions. One commenter on social media pointed directly to state policy in response to Wheyland’s death: “So sad – CA needs tougher deterrents and stronger laws.”
